The Commission shall advise candidates for all the vacancies reported and pending before them and the vacancies which may be reported to them for the period during which the ranked lists are kept alive in the order of priority, if any, and in the order of merit subject to the rules of reservation and rotation, wherever they are applicable.

PSC has no case that the empanellment of Drivers in KSRTC is made not against a post born on the cadre of its service, nor they have a case that such empanellment was made not to meet an emergency to fill up vacancies in that cadre. None of the certificates produced by the petitioners will indicate the extent of provisional service. It is pointed out that the empanelled Drivers, conductors and other staff of KSRTC were absorbed into regular service by virtue of various redults issued with approval of the Government.
Provided further that a ranked list from which no candidate is advised during the period of one year from the date on which it was brought into force shall be kept in force till the expiry of three years from the said date and in a case where no candidate is advised from the ranked list till the expiry of the said period of three years, the duration of the ranked list shall be extended by the Commission for a further period of one year or till at least one candidate is advised from the list whichever is earlier.
Provided that the above rule shall not apply in respect of ranked lists of candidates for admission to Training Courses that leads to automatic appointment to Services or posts and that in such cases the Ranked Lists shall cease to be in force after one year from the date of finalisation of the Ranked Lists or after one month from the date of commencement of the course in respect of the last batch selected from the list within a period of one year from the date of finalisation of the ranked lists whichever is later.

Per contra, contention of the learned standing counsel for PSC is that, there was no appointment on a provisional basis and the empanellment of Drivers is only a temporary engagement. Home Archives Rank Lists Eventhough learned Standing Counsel attempted to draw a distinction between ‘appointment’ and ‘engagement’, I do not find any provision prescribing any such separate method for engaging persons against sanctioned posts on temporary basis.
Contention of the petitioners is that, service rendered by them as empanelled Drivers is provisional service and going by the resuults in Ext. P1 notification is indicative of only persons appointed on temporary basis.

Section 3 of the said Act insists that, the Corporation may consult the PSC on all matters relating to recruitment of senior officers and on the principles to be followed in making appointment by direct recruitment with respect to servants of the Corporation. P1 can be imported only with the meaning that those who are temporarily appointed against a sanctioned cadre to work for any specific period or till the coming of the regular hands.
According to PSC, the engagement as empanelled Drivers was only a temporary arrangement for intermittent periods, and it was not a continuous employment.

On a perusal of certificates produced in all these writ petitions it is evident that, the date of commencement of service as empanelled Drivers in the respective units are indicated specifically.
On the basis of Exts. It is contended that the empanelled Drivers are engaged only as and when regular Drivers are not available. But the learned Standing Counsel for PSC submitted that the opinion of the Government was discussed by the Commission and the same was found as not acceptable, because it will go against the qualification prescribed for candidates. It is noticed that in some of these cases by virtue of interim orders issued, the petitioners were permitted to attend ‘Road Test’ as well as written test.
